Terms of service
These Terms govern the use of the AppAlbania GPS GPS tracking platform and related services provided by AppAlbania, Tiranë, Shqipëri (“we”). By creating an account, signing an offer or using the service, you (the “Customer”) accept these Terms, our Privacy Policy and the Data Processing Agreement. If the Albanian and English versions differ, the Albanian version prevails.
1. The service
AppAlbania GPS is an online platform for tracking vehicles and assets: live map, movement history, alerts, geofences, reports, API and other features described in your plan. We offer two service models:
- Full service (with installation): we supply the GPS device, a SIM card with mobile data and install it in the vehicle, for a one-time device and installation fee plus a monthly fee per vehicle.
- Connect your GPS (SaaS): you connect a tracker you already own to our server and pay a monthly subscription based on the number of devices.
We may improve or change the platform without materially reducing the features you paid for.
2. Account
- You must be at least 18 years old or legally represent a business or organisation.
- The details you provide (name, email, phone, billing details) must be accurate and kept up to date.
- You are responsible for passwords, for the users you add to the account and for everything they do. We recommend two-step verification (2FA).
- Tell us immediately at info@appalbania.com about any unauthorised use.
3. Lawful use of tracking
- You may only use the service for vehicles and devices you own or lawfully use.
- If you track vehicles driven by employees, contractors or customers (for example rental cars), you are the controller of that data and must inform them in advance and have a legal basis. We provide an employee notice template.
- Covert tracking of people, stalking, or any use that violates privacy or the law is strictly forbidden.
4. Payments
- SaaS subscriptions are paid in advance every month (or every year with annual billing) and renew automatically until cancelled. Card payments are processed by Stripe; we never see or store card details.
- Full service is invoiced according to the signed offer: a one-time device and installation fee and a monthly fee per vehicle.
- Prices are in euro. Taxes apply according to the law in force.
- We will email you at least 30 days before any price change; it applies from the next period.
- If an invoice remains unpaid, after notice the account may become read-only and then be suspended until the balance is settled.
5. Trial, contract and cancellation
- SaaS plans may include a free trial. At its end you choose a plan, or the account stops receiving data.
- You may cancel SaaS subscriptions at any time; cancellation takes effect at the end of the paid period. Payments made are not refunded unless required by law.
- Full service has a minimum term of 12 months unless the offer says otherwise. Early termination, device ownership and warranty are set out in the offer or contract.
6. Devices, SIM and installation
- For full service, installation is done by our technicians or authorised partners. The Customer provides access to the vehicle at the agreed time.
- We are not liable for damage caused by unauthorised people tampering with the device or installation.
- In the SaaS model you are responsible for the device, SIM card, data credit and configuration. We provide guides but do not guarantee that every model works.
7. Remote engine stop
Where the device and plan support it, you can send an engine-stop command. It is only available to authorised users, requires an extra confirmation and is blocked while the vehicle moves faster than 5 km/h. You are responsible for its use and for the safety of people and the vehicle. We are not liable for damage resulting from the use, misuse or non-execution of the command.
8. Accuracy and availability
GPS positions depend on satellite signal, the mobile network, the device and the installation. We do not guarantee that data will always be accurate, complete or real-time. The service is not an emergency system and does not replace calling the police or emergency services. We aim for high availability, but there may be interruptions for maintenance, security reasons or third-party provider issues.
9. Data and retention
- Vehicle and position data remain yours. We process it on your behalf under the Data Processing Agreement.
- History is kept for the period defined in your plan and then deleted automatically.
- You can export your data from the panel. After the account is closed, data is deleted within 30 days, except what the law requires us to keep.
10. API and integrations
API keys are personal to your account and must be kept secret. We may apply usage limits per plan and block keys that are used abusively or put the system at risk.
11. Suspension and termination
We may suspend or terminate the service for non-payment, breach of these Terms or of the law, security risk, or at the request of a competent authority. Where possible, we notify you in advance.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect damages, loss of profit, revenue or data, or for theft of or damage to the vehicle. Our total liability for any claim is limited to the amount you paid for the service in the 3 months before the event. Nothing in these Terms limits liability that cannot be limited by law.
13. Changes to these Terms
We may update these Terms. For material changes we notify you by email or in the panel at least 15 days in advance. Continued use after they take effect means you accept them.
14. Governing law
These Terms are governed by the laws of the Republic of Albania. Disputes are first resolved amicably; otherwise by the competent court in Tirana. This does not affect mandatory consumer rights.
